The 18-year-old Lapsus$ hacker who played a critical role in leaking Grand Theft Auto VI footage has been sentenced to life inside a hospital prison, according to a report from the BBC. A British judge ruled on Thursday that Arion Kurtaj is a high risk to the public because he still wants to commit cybercrimes.
In August, a London jury found that Kurtaj carried out cyberattacks against GTA VI developer Rockstar Games and other companies, including Uber and Nvidia. However, since Kurtaj has autism and was deemed unfit to stand trial, the jury was asked to determine whether he committed the acts in question, not whether he did so with criminal intent.
Life for this seems absolutely insane.
I don't think the kid will actually serve it out in prison though. The primary issue here seems to be that the kid is actively saying they will commit more crimes. No matter the crime, you can't really give a light sentence to someone telling you, in a court of law, that they will do it again.
The ideal would be that they rehabilitate him until he's able to be safely released with no fear of repeat offense, or at the very least, until the kid is smart enough to lie.
It's not prison, it's some sort of prison hospital. But still, life is the exact opposite end of the spectrum compared to a light sentence. Like you said, rehabilitation should be the goal, and imposing life sentences on 18 year olds is not how you make that happen.

I'm not really sure what anyone thinks WOULD be just and proper in this kind of situation. I don't know many details of this particular case, but if there has been due process that determines someone is unsafe to release into society because they lack social capacity, releasing them anyway hardly seems like justice.
I'd like to believe -- though I know it basically isn't true -- that the justice system exists for the sake of justice. That it is primarily concerned with making whole the victims and making sure the criminals are rehabilitated such that they can safely rejoin society and even contribute to it in the future. I think that's how the justice system should work in a fair and just world. But if you have someone who is actually incapable of rejoining society, what are you supposed to do?
If we want to focus on the awfulness of this situation, I don't think the sentence is the issue. I think the focus would need to be on whether or not the hospital treatment has any chance of being effective -- because if it doesn't, THAT'S the story that matters.

Yeah, I'm getting bothered by this too. My brother had a pretty bad case of autism, he suffered from hard-to-control anger issues, but he learned how to keep those outbursts from causing damage or harming the people around him.

You know, emotional regulation and self control? And I also guarantee that the cops and guards were treating him like shit. They LOVE picking on disabled people. Most people are able to restrain themselves from physically attacking people in those circumstances. Why is it okay to try to beat up people when you're being lawfully detained? The part I don't get that no-one has mentioned is that Rockstar stated in court that it cost them $5million to recover from the attack. What does that even mean? They spent $5mil on lawyers to recover the video footage? They spent that on upgrading security (which arguably should have been in place already if they could be hacked with a fire stick and a landline). Or have they been selling $5mil less of Shark Cards than they were expecting?

I've been around for this kind of thing. Similar to grants. When the money is flowing, management just goes around and earmarks various things on the budget sheets and asks the data folks for reports to back it up. Some of it could be true. Most of it is a stretch.
I usually buy a game on release if it's good or if I trust the company -- when I heard Armored Core 6 came out, I made a note to go buy it because FromSoft is amazing. And once again, they didn't miss.

That's a very distorted description of what's actually happening. The person (he's 18 so no longer really a "kid") had been violent while in custody with dozens of reports of injury or property damage, and continued to express the intent to return to cybercrime as soon as possible. Furthermore, the "life" sentence is only until the doctors think he's no longer a danger. It sounds like this guy is a real piece of work and the sentence is rooted in the goals of rehabilitation and protecting the public rather than some kind of retribution.
I have no opinion on the person in question but depending on how severe their autism is it changes the narrative of physical outbursts a bit.
The cause of the outbursts is understandable, and I empathize. But the outbursts are still outbursts, and we can't pretend they aren't a problem that has to be dealt with because we don't want to mistreat someone with autism. The title is editorialized. He was put in a hospital because he attacked people during the arrest and is considered dangerous physically. He hasn't even had a trial for the hacker stuff.
Here's a better source with more information. He is a career criminal already who has hacked a lot more than just Rockstar. I'm not saying that a fucking life sentence is justified, but the Verge isn't doing its due diligence in reporting all the facts on why they gave him such a drastic sentence. The fact that he has already done a lot of damage and says that he will do so again isn't great for him.

So this was the kid that committed the cybercrime using a fire stick while out on bail due to other cybercrime. And in this process he shows no remorse to stop doing cyber crime. And the doctors of this lifetime prison hospital get discretion on when to release him if he shows remorse? Administrative medical prison sentencing is usually fucked up and unfair, but it sounds like this kid has a path forward to eventually get released.

I had PTSD after being held in a psychiatric ward for a few days. Granted this was in the US (in a major Texas city), but if the UK's mental health is anything like the US, that kid's never coming out.
I have ptsd from my experiences with nhs mental health services. This kid is going to be destroyed. My heart goes out to them, this is so incresibly unjust.
It's been a while and my PTSD was milder so it's pretty much gone at this point, but it really sucks how bad emergency mental health services are. It meant I learned the wrong lesson from being hospitalized: never tell someone if you're suicidal because they might call 911 instead of helping you find a better place to stay. I've heard there are a lot of good mental health hospitals in the US, but they tend to be (even more) expensive and are almost never the emergency care facilities.
Not sure if the UK has a similar situation, where the good places aren't covered or are on extremely long wait lists, and the shitty, abusive places are the places people usually get sent, but I feel bad for him. He should be given a job and a therapist, not a psych ward where the nurses are jaded and probably not paid enough to give a shit while the doctors are either burned out or trying to make the best of a shitty situation.
This is rough chief, a week in something like a mental hospital was hell, can’t imagine a prison hospital for life

I mean he was smart with computers, but he's openly telling the courts he intends to do his crimes and is being violent in prison... So what do you really expect here?

You can't tell me he'd have gotten in as much trouble if he had robbed any one of us. He made a corporation look dumb, that's why they went so heavy on him
One of the reasons he's in forced medical detention is because one of the things he threatened to do was steal and leak user data. So in a way, he actually is in trouble for trying to do the same to one of us
Do any one of us have multi-million dollar IPs that were breached? The scale is 100% the issue here, he's caused millions in damages, far more than if he were to have stolen from any Joe Schmoe.
His leak got people hyped, and if anything made them more money
He has a disability/issues that he was sentenced to a hospital for, he can be released if he is deemed not a danger to himself or others, he was also physically violent apparently and they are giving him treatment in a secure setting. I don't know if the place he is going is good or anything about the treatment but it's not exactly a prison life sentence.
